Liability is largely with our insured, but not entirely.
Ruiz says he was in the centre lane at roughly 55 mph, moved right when traffic ahead braked, and struck the claimant's vehicle in the blind spot. He concedes he did not signal. He also says the claimant's brake lights were not working — that is the one fact that cuts our way, and it appears nowhere in the crash report.
Two contradictions with the report:
- The report places the impact in the right lane; Ruiz describes it as happening during the lane change, straddling the line. Minor, but it affects comparative fault.
- The report records "no injuries at scene." Ruiz says the claimant was holding her neck when he walked over. Expect that to surface in the demand.
Transcript is attached with timestamps on both points. I would get the claimant vehicle inspected for the brake light before it's repaired — that's a comparative-fault argument with a short shelf life.
