Pemberton — vacancy provision and the utility records

Pemberton — Freeze burst, vacant property · RM-2026-03977
Standard
Pemberton: the insured says the building was tenanted. Does the vacancy provision bite? Check the utility records before you answer.

The vacancy provision probably does not apply, but the record is thinner than I would like.

The policy suspends coverage after 60 consecutive days of vacancy. Utility billing shows continuous water and electric usage through the loss date — low, but non-zero every month, with a 41% drop from March onward. Gas was disconnected in February.

The lease file supports occupancy: a month-to-month tenancy signed 4 Nov 2025, no termination notice on file.

Where this needs your eyes: low usage plus a gas disconnect is the pattern an SIU referral would flag. If you want the position to hold, get a recorded statement from the tenant confirming residence through the loss date. Without it we are relying on billing inference alone.
